What does berigtigelse mean? Berigtigelse (deed completion) refers to the process of reviewing and finalizing all the necessary documents and formalities in connection with buying or selling a home. It typically involves a number of legal procedures, such as tinglysning (land registration) of the skøde (the deed) and the transfer of payment via a lawyer or other legal representative. Completing a skøde can, for example, involve correcting name errors, incorrect information about the property's area, or a signature error.

In practice, berigtigelse ensures that all contracts and documents are in order, and that there are no obstacles to completing the transaction. It also includes making sure that property taxes, mortgage deeds, and other relevant documents and formalities are in order, and that everything has been signed and approved by the relevant parties.

Berigtigelse is an important process for both buyer and seller, since it ensures that the transaction is completed in a safe and legally correct manner. It's important to have a lawyer or other legal representative help with the completion process to make sure everything is in order and to avoid any legal problems or surprises later on.

As an owner of a co-operative housing share, you own a share of the building and therefore also of the collective assets.

Do note, however, that as a co-operative housing owner you have the right to use a home in the building, and therefore do not directly own the specific apartment you have acquired.

How is a berigtigelse carried out? Once you've obtained the necessary documents and reviewed them carefully to make sure there are no errors or discrepancies, you can begin filling out the completion declaration (berigtigelseserklæring). The completion declaration is the formal statement showing that all necessary corrections have been made.

The completion declaration must be signed by all parties involved in the property transaction, including both buyer and seller as well as any lenders and mortgage holders. It's important to make sure the completion declaration is signed correctly and in accordance with local laws and regulations.

Once the completion declaration has been signed, it must be sent for tinglysning (land registration). The land registry will review the declaration and make sure it complies with local laws and regulations before updating the property's records.

Once the land registration is complete, the property's records will be up to date and corrected, and the property will be ready for sale or transfer.

It's important to note that the berigtigelse process can vary depending on the specific situation and local laws and regulations. It's therefore important to seek professional advice if you have questions or are unsure how to complete the process for your property.

Who completes a transaction? It's normally the buyer and seller together who are responsible for completing a transaction and making sure all necessary documents and corrections are in place. It's important to ensure that all parties agree on the corrections before they are made and submitted for land registration. It's also important to make sure the completion process complies with local laws and regulations. If you're unsure how to complete a transaction, it can be a good idea to seek professional advice from a property lawyer or estate agent.

Order of steps for berigtigelse The purchase agreement is signed by seller and buyer, with any reservations noted. The buyer deposits a down payment with the seller's estate agent or bank. The buyer provides a bank guarantee for the purchase price. The legal advisor or estate agent handling the completion sends a draft of the skøde (deed) to both parties for approval. Once the deed is approved, it is signed by both parties. Signing takes place digitally. The deed is submitted for land registration. Title insurance (ejerskifteforsikring) Settlement statement (refusionsopgørelse) The purchase price is released to the seller. The buyer and their advisor must ensure: Bank approval Financing of the purchase Choice of loan offer Down payment to the estate agent (typically 5% of the purchase price) A bank guarantee, which is replaced by a cash deposit on the day of takeover Land registration of the deed Taking out title insurance Taking out home insurance If, as a buyer, you fail to meet the payment deadlines or other terms agreed in the purchase agreement, this can result in additional payment in the form of interest (Section 5 of the Danish Interest Act) and the buyer may also risk having the deal cancelled.

We therefore recommend using a buyer's advisory service. This way, you ensure that you have an overview of the transaction and that all deadlines are met
